Impaired Driving – Civilian Statements

Consider asking the following questions of civilian witnesses

  • Date, Time and Location
    • Where did their observations start?
    • How long did they have accused under observation?
  • Identity of the Driver
    • How many people were in the vehicle?
    • Did they see the driver behind the wheel of the vehicle?
    • Was the driver the same person you took into custody?
    • Description details
  • Observations of Driving
    • Did the witness observe the driving? Care and Control?
    • Speeding? Weaving? Infractions?
  • Observations of Driver
    • Did the driver appear impaired to the witness?
    • See common indicators of impairment
    • Witnesses experience with people impaired by alcohol or drugs
    • Did they observe the accused consume drugs or alcohol before or after stop/accident?
    • Continuity of observations of accused – explain any time they did not have accused under observation.
  • Did they speak to the driver?
    • Details of conversation
    • Obtain reports from ambulance or fire units who attended
