Mischief Relating to Religious Property(Cemetery) – Section 430(4.1)
In addition to meeting the elements of mischief, (see elements of damage to property) the following additional elements must be met
- The property is used primarily for religious worship, including (but not necessarily limited to) a church, mosque, synagogue or temple, or a cemetery, AND…
- The damage is done to a building, , structure or part thereof OR…
- an object associated with religious worship, on the grounds
- AND the mischief must be motivated by
- bias, prejudice or hate
- relating to religion, race, colour, or national or ethnic origin.
